Introduction
These Terms & Conditions ("Terms") govern access to and use of the Twikkie platform, website, applications, APIs, mobile applications and related services ("Services") provided by Twikkie.
By accessing, subscribing to or using Twikkie, the customer agrees to be bound by these Terms.
If you are accepting these Terms on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.
About Twikkie
Twikkie is a UK-built workforce and operations platform designed to support workforce management, recruitment, payroll-related operations, collaboration, workflow automation, document management and operational productivity.
Twikkie provides cloud-based software services which may evolve, expand or change over time.
Scope of Services
Twikkie may provide functionality including but not limited to:
- Workforce & HR Management
- Recruitment & Hiring
- Payroll & Compensation Management
- Attendance & Workforce Monitoring
- Absence Management
- Onboarding & Offboarding
- Workflow & Approval Management
- Document Management
- Collaboration & Messaging
- Case Management
- Reporting & Analytics
- AI-assisted operational tools
- Mobile application access
- API and integration services
Certain services may be optional, configurable or subscription-dependent.
Account Registration & Customer Responsibilities
Customers agree to:
- Provide accurate information
- Maintain secure credentials
- Restrict access to authorised users only
- Maintain appropriate internal governance
- Use the Services lawfully and ethically
- Comply with employment, payroll, privacy and data protection laws applicable to their organisation
Customers are solely responsible for:
- User management
- Internal permissions
- Workforce decisions
- Recruitment decisions
- Payroll decisions
- Compliance obligations
- Data accuracy entered into the platform
Acceptable Use
Customers and users must not:
- Attempt unauthorised system access
- Interfere with platform security
- Upload malicious software or harmful content
- Misuse employee or candidate information
- Use the platform for unlawful, discriminatory or fraudulent purposes
- Reverse engineer or copy the platform
- Attempt to access another customer's data
Twikkie reserves the right to suspend or terminate access where misuse is identified.
AI-Assisted Features Disclaimer
ImportantTwikkie provides AI-assisted functionality intended to support operational efficiency and decision-making.
AI-assisted outputs may include:
- Candidate summaries
- Match scoring
- Job description generation
- Interview question generation
- Suggested responses
- Workflow recommendations
- Reporting summaries
- Operational insights
AI outputs are generated automatically and may contain inaccuracies, omissions or recommendations requiring human review.
Customers remain solely responsible for:
- Final decisions
- Recruitment outcomes
- Payroll decisions
- Employment actions
- Regulatory compliance
- Operational approvals
Twikkie does not guarantee:
- Hiring outcomes
- Elimination of bias
- Accuracy of AI-generated outputs
- Compliance outcomes
- Operational results
AI functionality is intended as operational assistance only and not as a substitute for professional judgement.
Recruitment & Candidate Data
Customers using recruitment functionality are responsible for:
- Lawful candidate data processing
- Candidate communications
- Hiring compliance
- Fair and non-discriminatory recruitment practices
- Managing candidate retention obligations
Twikkie may provide anonymisation and bias-reduction functionality but cannot guarantee the elimination of bias in recruitment decisions.
Payroll & Compensation Disclaimer
ImportantTwikkie may support payroll preparation, compensation management and payroll-related workflows.
Unless explicitly agreed otherwise in writing:
- Twikkie is not a payroll bureau
- Twikkie does not guarantee payroll calculation accuracy
- Customers remain responsible for validating payroll outputs
- Customers remain responsible for tax, pension and statutory compliance obligations
Where payroll administration partners are used, additional third-party terms may apply.
Data Protection & Privacy
Twikkie processes customer and workforce data in accordance with applicable data protection laws.
Data processed may include:
- Employee records
- Candidate information
- Compensation data
- Attendance records
- Documents
- Messages and communications
- Workflow activity
- Audit logs
- Operational records
Twikkie does not sell customer data.
Customers remain the data controllers of information uploaded into the platform unless otherwise agreed.
Security & Access Controls
Twikkie implements reasonable technical and organisational security measures including:
- Role-based access control
- Audit logging
- Access restrictions
- Data segregation
- Encryption measures where applicable
- Authentication controls
- Infrastructure monitoring
Customers remain responsible for:
- User access governance
- Internal security policies
- Credential management
- Device security
No internet-based system can guarantee absolute security.
Data Retention & Deletion
Twikkie may provide configurable retention and deletion controls.
Customers are responsible for:
- Determining appropriate retention periods
- Managing deletion obligations
- Ensuring lawful retention practices
Twikkie may delete or anonymise data following:
- Subscription termination
- Retention expiry
- Customer instruction
- Legal requirements
Platform Availability & Support
Twikkie targets high service availability subject to:
- Planned maintenance
- Emergency maintenance
- Infrastructure issues
- Third-party outages
- Force majeure events
- Security incidents
Twikkie does not guarantee uninterrupted or error-free service availability.
Support levels may vary depending on subscription or contractual agreements.
Third-Party Services & Integrations
Twikkie may integrate with third-party providers including:
- Email providers
- Calendar providers
- Recruitment platforms
- Cloud hosting providers
- AI providers
- Payroll administration providers
Twikkie is not responsible for:
- Third-party outages
- Third-party security incidents
- External platform changes
- Third-party data processing practices
Use of third-party integrations may be subject to additional provider terms.
Intellectual Property
All Twikkie software, branding, documentation, AI models, workflows and platform functionality remain the property of Twikkie or its licensors.
Customers retain ownership of:
- Their organisational data
- Uploaded documents
- Employee records
- Candidate information
Customers grant Twikkie limited rights necessary to provide the Services.
Confidentiality
Both parties agree to protect confidential information disclosed during the use of the Services.
Confidential information must not be disclosed to unauthorised third parties except where required by law.
Fees, Billing & Refunds
Subscription fees are billed in advance based on the selected subscription plan, modules, user volume and billing cycle.
Subscriptions may be:
- Monthly
- Annual
- Contract-based
- Custom-priced depending on organisational requirements
Unless otherwise agreed in writing or required by applicable law, fees paid are non-refundable and Twikkie does not provide refunds or credits for:
- Partial subscription periods
- Unused services
- Unused user seats
- Downgraded plans
- Cancelled subscriptions
- Early termination of Services
Customers are encouraged to evaluate the Services during any applicable free trial period prior to purchasing a subscription.
Subscriptions may renew automatically at the end of the applicable billing period unless cancelled in accordance with the customer's subscription settings, agreement or applicable notice period.
Failure to pay applicable fees may result in suspension or termination of access to the Services.
Taxes are additional where applicable.
Twikkie reserves the right to modify pricing, subscription structures or platform packaging upon reasonable notice.
Twikkie may, at its sole discretion, consider exceptional billing or refund requests on a case-by-case basis.
Suspension & Termination
Twikkie reserves the right to suspend or terminate Services where:
- Terms are breached
- Fees remain unpaid
- Security risks are identified
- Illegal or harmful activity is suspected
Customers may terminate subscriptions subject to contractual notice periods.
Limitation of Liability
ImportantTo the maximum extent permitted by law, Twikkie shall not be liable for:
- Indirect or consequential losses
- Loss of profit
- Business interruption
- Recruitment outcomes
- Payroll errors caused by customer data
- Operational decisions
- Data loss arising from customer actions
- Third-party service failures
Total liability shall not exceed fees paid by the customer within the preceding 12 months unless otherwise required by law.
Changes to Services & Terms
Twikkie may:
- Modify platform functionality
- Improve features
- Retire services
- Update these Terms periodically
Continued use of the platform constitutes acceptance of updated Terms.
Governing Law
These Terms shall be governed by the laws of England and Wales.
Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
